The Law Office of J. Patrick Sutton
I practice in Texas and Washington State.

In Texas, in addition to having my own firm, I am Of Counsel to the Gottfried Alexander law firm.

Nationwide, I assist other lawyers with HOA and deed restriction cases.

Civil appeals constitute more than half my practice. My current appeals list is here. I argue before the following courts:

  • Texas Supreme Court
  • Texas 2nd, 3rd, 4th, 5th, 8th, 9th, 12th, 13th, and 14th Courts of Appeals
  • Fifth Circuit U.S. Court of Appeals
  • U.S. Supreme Court (petitions for certiorari, responses to petitions for certiorari)

Real estate disputes are my core practice. This is chiefly HOA law, deed restrictions (aka, "restrictive covenants"), challenges to city ordinances which deprive citizens of property rights, and property rights generally.

Planning, Zoning, Permitting, and Municipal Appeals. In the northwestern areas of Washington State, I help property owners and developers get local government approvals.

I am best known for my HOA and deed restriction work. I help homeowners in dire situations involving HOA abuse. HOA's make bad decisions or otherwise don't help the people they're supposed to protect. Many HOA Boards are overly secretive. Some are corrupt. Some are vindictive and retaliatory. I help homeowners fight these HOA's. I also help extricate homeowners from problems of their own making: sometimes, homeowners have done something they should not have don't know how to fix it.

More recently, I have led the charge statewide in Texas in challenges to city bans on short-term leasing.

I am proudly not a member of HOA trade associations, and I am not beholden to any HOA or real estate industry group.
