The Law Office of J. Patrick Sutton
I have a statewide practice. I handle some matters in my solo firm, while others are handled through a firm with which I am affiliated. I help other lawyers with HOA and deed restriction cases because I've handled so many. I charge for consultations, which are working sessions where I review your situation and provide advice.

State and federal civil appeals are about half my practice. I write readable briefs as free from legal jargon as possible. My current appeals list is here. I have argued before the following courts:

  • Texas Supreme Court (petitions and merits)
  • Texas 2nd, 3rd, 4th, 5th, 8th, 9th, 12th, 13th, and 14th Courts of Appeals
  • Fifth Circuit U.S. Court of Appeals in New Orleans
  • U.S. Supreme Court (petitions for certiorari, responses to petitions for certiorari)

Real estate disputes and lawsuits are my core practice, including the appeals of such cases. This is chiefly HOA law, deed restrictions (aka, "restrictive covenants"), and property rights generally. It also includes real estate fraud and commercial real estate disputes.

I am best known for my HOA and deed restriction work. I help homeowners in dire situations involving HOA abuse. HOA's make bad decisions or otherwise don't help the people they're supposed to protect. Many HOA Boards are overly secretive. Some are corrupt. Some are vindictive and retaliatory. I help homeowners fight these HOA's. I also help extricate homeowners from problems of their own making: sometimes, homeowners have done something they should not have don't know how to fix it.

I am proudly not a member of HOA trade associations, and I am not beholden to any HOA or real estate industry group.

3. Finally, I review and handle
residential real estate transactions, often to review deed restrictions and local laws as concerns the rights an owner has, sometimes to represent buyer or seller in the deal. I handle for-sale-by-owner deals (FSBO).
